Off Lease 30 Day notice

I have been off lease since July 07 with no signed document outlining my responsibilities to them, no month to month agreement. Today is the 16th and I have am looking to vacate on the May 4th. The landlord company is trying to ding me for not giving 30 days notice and wants to charge me until the 16th of May, adding on an extra 11 days and $1000 in excess rent. I was told that if i do not pay that I will have the remainder removed from my deposit.

I was hoping they would just prorate until the 4th, but will not do so. Since there is no document binding us do they have the right to withold my deposit? I even said i would leave on the 1st, which is still not good enough for them. Can i take them to small claims court and have a chance of winning?

Read your lease agreement carefully... for some leases, you don't have to physically renew a piece of paper. I am sure there is a provision on your lease regarding notices.
 
so i have no rights if it goes to small claims court? Very typical, he who has property prevails.
 
OMG seriously, is that helping? Thanks for chiming in. Life doesn't always present itself with the option to have 30 days notice, and rather that standing by the side of a major slum housing corporation that has dozens of lawsuits across 10 states, maybe be a little more sympathetic.
 
You came here for legal advice not pity. How you you feel if Lanldord asked you to vacate in a time frame not allowed by law? This isn't about you its about what the Landlord can legally do. He can legally seek those extra days. Now could he forgive it sure he could but he does not have to. Don't shoot the messenger!
