OK, Advice needed on deposit

Jun 5, 2008. Me and my girlfriend went and looked at a trailer that was for rent, the first one we looked at had roaches so we declined the first trailer, he told us that he was fixing up another trailer and that if we wanted to look at it we could, so we go and look at the second trailer which was considerably bigger, and on a bigger lot, he jhad it pretty well gutted saying that it was being worked on and was going to be finished the following week on Friday the 13th (that should have been my first sign) so we were VERY interested in the trailer for rent, so we went ahead and put the $250 deposit for it down but did not sign the lease agreement I said "I don't want to sign a lease until the trailer is finished so I can make my final decision" and yes your going to say my first mistake was putting the deposit down when I could have waited but I gave them the deposit so they don't put it on the market and took us as serious applicants. So a week passes we go and look at it not on the 13th but on the 18th due to conflicting scheduels, we pull up to the trailer and the trailer was not finished as a matter of fact it was in worse condition than when we had originally looked at it, so I talked to the woman that I gave the deposit to and asked her what the time frame was, she told me another week, we didn't have that amount of time and would have had to sign another lease at our current appartment complex and told her "I don't believe that will work out for us, we will have to sign a six month lease before this is done and can get moved. I don't like that way it looks we have changed our minds and would like our deposit back" she first off told me "No" and I asked her why she said "We have not advertised this trailer because you put a deposit down and we have lost possible applicants" I told her I didn't understand because the trailer was not finished when I was told it was supposed to be finished so then she told me she would talk to her husband I then told her "Okay maybe im being hasty, i'll wait untill the trailer is finished then we will decide" (Knowing we couldn't get it anyways becuase of our current lease ending and needing a place to live having my two daughters their monther and myself) Her attitude changed and said "Okay well i'll talk to my husband about your deposit" so this all happend on June 18th, I don't hear from them again about the trailer being finished until July 7th and we had alrady had to sign another 6month lease with ourt appartment complex she calls me and say "The trailer is finished if you would like to come look at it and tell us if you want it or not" and I told her "We can't we have already signed another lease where we are currently living, But can we discujss tjhe deposit" she says "Yeah, I talked to my attorney about that and he said I don't have to give it back and i'll give you $50 for gas and travel" I refused saying "No I would like my deposit back I haven't stopped you from selling the place considering it is just now finished" she still denied and said her attorney said she didn't have to and I can discuss it with her attorney and sjhe gave me his number, so now I am pursuing some legal help myself before I talk to this attorney and wonder how this case would hold in court considering I signed no lease agreement and have cause no damages to the trailer and the trailer was not done when I was told it was going to be done.
Should I not let this lady jerk me around and take it to court or am I wrong and should just let it go I know its only $250 dollars but I think she might be trying to take advantage of me thinking that I won't do anything considering I am 20 yrs old and intimidating me with her attorney....need help sorry for such a long message but thought I should supply you with the complete accurate information.
 
You might be dead in the water here. Even though trailer was not finished they were clearly showing it as you saw it. When you gave the deposit you held the trailer for yourself. Since the deposit had no written agreement attached to it its presumed deposit was to hold trailer. You could wind up spending much money on an Attorney with you gainning nothing. In fact you would lose both deposit and Attorney fees. If you talk to an Attorney meet with one on a free consultation if offered. Honestly I dont see you getting your deposit back. Talk to an Attorney and if I think is correct turns out true than go back and get the $50.00 and cut your loses
 
This happend in Oklahoma...Could I possibly get them if they did not deposit my $250 deposit into an escrow account which is required by state law for deposits...or am I still with-out because of no written agreement. And the fact that they fell short on the trailer being ready whenever they had said it would have been them faulting on their end of our "verbal agreement". All I have is a receipt with the date the amount paid and NOT the landlords signature, but her daughters signature. Also my girlfriend looked over my post and recognized a mistake, I was wrong; We DID go to check on the trailer 7 days after we gave them the deposit. Although without any papers being signed with stupulations to me giving them $250 then I guess its just heresay
