Hi,
I quit my job on Monday. I work on a TN Visa. I understand that I have to get another company to sponsor a new TN Visa in order to start making money again in the USA. I work as independent worker for him (1099)
My problem is that my now old boss owes me $7000 in expenses and salary which he refuses to pay. I have files which he need to keep the business going. I asked him to send me a written payment plan and I would then give him the files.
Now, he is threatening to sue me personally for keeping files which belong to him (intellectual property). He asks his lawyer to sue me in USA and in Canada (doesn't make sense to me) and he asked that his lawyer complain about me to immigration. He also is now suing my boyfriend (who worked with us, but just got fired... when I quit).... saying that we damaged his business (no idea where that comes from).
Through all this suing, he is "advising me" to finished the work I started. That it would be in "my best interest".
On top of this, I think he is wrongfully using a lawyer's name. I responded to one of his e-mails, and the e-mail address of the lawyer bounced back. I did some research, and I think he is trying to scare me with false attorney e-mails (the e-mail address doesn't exist). His he allowed to wrongfully use an attorney's name like this?
I would love any advise.
If he owes me this money and doesn't want to pay me, am I ok to keep his files until we come to a payment agreement?
