old will - outdated executor

my mother originally made a will in 1993, when i was 10 yrs old. it stated that i was the sole beneficiary. [she was widowed and i was the only child.] it stated my uncle was the executor [since i was so young]. however, my mother just passed away a few weeks ago, and i have since then been taking care of everything, acting as executor. is there anyway that i can legally continue to do so? i am now 25 yrs olds and i know my mother would have intended for me to settle all her affairs. should i just go to the court and have them name me as executor, or should i find the old will?
i planned to do everything to take care of my mom:s belongings after she died. and i rather not harass my uncle. btw: i:m in brooklyn, ny.
 
If no will is found the estate, passes by intestacy and since you are the only child you will get everything. If a will is found, you can asked the named personal representative to relinquish his rights to you and petition the court to be named the personal representative.
 
some of the paperwork i:ve been getting asks for papers indicating that i:m the executioner or administrator of the will. but i don:t have such. do i need to go to the county clerk? i would rather just get this over with immediately without having to go to court unnecessarily.
