My question involves a consumer law issue in the State of: maryland

I purchased a HDTV from an Online retailer. The model I purchased was for 1,139.00. This model was apparently out of stock. They called and asked if I would like to get a newer model TV for $150 more and it would ship that day. I said yes however they never gave me the name of the newer model or asked for confirmation of the amount they would charge me. They ended up charging my Credit Card 1,489.00 (350 more). I called confused as to what was going on and they stated that after a mail in rebate of 200 the price would be 1,289 which they quoted me. They never stated any of this in the initial call so I said I wanted to just cancel the order. They stated that the item was already shipped and there was nothing I could do. They say I can either pay $400 shipping costs to return the TV or just accept the TV they give me.

Is this even legal? Can I call my credit card company and have them reverse the charge and refuse shipment since it isn't the item (or the item I agreed to get on the phone since they never told me what it would be) I originally ordered or the amount I agreed to pay? Could they sue me for the shipping costs?

See what the return policy is for the online retailer - you should have gotten a disclaimer when you finished the online transaction regarding policies. If the item is in transit, refuse the shipment and have the credit card company charge back the amount. The online retailer will have to explain to the CC company that they have gotten the TV back from the delivery company. The item you are receiving is not the item you agreed to purchase. Good Luck!
