My parents passed away in January 2008 and their will simply stated that everything is divided equally between my brother and myself. My brother passed away 2 weeks ago. Does all the property and assets go to me and me alone or can my sister-in-law claim half...? Me and my brother were not finished cleaning out the house and had an estate sale planned in December. Just need to know my legal rights...I have an appointment scheduled with a family law attorney next week - but sister-in-law is calling me - demanding items back that my brother and I had already split. Thanks for any information you have.

Whatever should have gone to your brother now goes to his estate. It does not go to you. What happens to it now that he is deceased is determined by his will (or, if he has no will, by the laws of intestacy in your state). I would imagine his surviving wife has a very strong claim to it.
