I recently received an open intox ticket in ottawa county in michigan. I am 22 and was a passage in a vehicle and had an open beer container. I was told by the court there would only be fines. I appeared in court and received fines as well as 5 days in jail.

When i thought i was done with it all, i got letters saying my license is suspended for 1 month, and restricted for 2 more. I have no previous driving violations, and was wondering if anyone knows whether this is legal, since i was not even driving?

I tried reseraching the consequences of open intoxes online and have yet to find anything of relevance. Thank you in advance for any info.

You were over 21 at the time of the incident? The Open Intox statute, MCL 257.624a, does not seem to provide for a license suspension, but a second offense Michigan MIP charge carries a suspension of 90 days, with a restricted license possible after 30 days.
