I received an open intox in public citation the other day and was wondering what to expect. I had a bottle of liquor and the seal was broken, but I was walking down the street to my house. I hadn't been drinking from it, I was only carrying it back to my house for a friend.

What worries me is that I received an OWI about eight months ago and was wondering how badly this second alcohol related charge is going to effect me. Can they revoke my liscence? Will I only have to pay a fine? Jail time? Probation?

Are you still on probation? Are you under 21?

I'll assume that the bottle wasn't in a bag, but was visible, which is why the Police stopped you.

I'm in Michigan. A lot depends on what area of what county you are in. For example, if you are in most of Oakland County, the prosecution will probably go after you pretty hard. Other areas, not much of a problem. . .

I live in East Lansing as well. So you'll get Judge Jordan or Ball. YOu can expect a stern lecture, and minimal probation. E.L. for your charge is probably one of the most lenient places. But, if you do anything "riot related", etc, as you know, they'll bury you.

Good Luck. If you want Attorney Recommendations just private e-mail me.
