My wife and I have been participating in an open marriage for 8 yrs. we met a woman and she and my wife fell in love. I began to develop feelings as well and my wife encourages those feelings.

My feelings kept growing and the other woman decided that she did not want to continue a relationship with my wife. I was torn between the two and have chosen to be with the woman.

Can my wife file adultery?

It doesn't matter in Texas.

Texas is a pure community property state.

That means that she and you will normally split the marital estate 50/50.

There are exceptions, and I suggest you speak with a family law or divorce attorney in your county.

She can even get the court to require you to pay for her lawyer, if you earn appreciably more than she does, and even get a court order to require you to pay temporary spousal support.

If she earns appreciably more than you, you could employ the same tactic.

So, if you're smart, get thee to a lawyer and discuss a cross complaint and filing.
