Landlord did not provide lead based paint dislosure on pre 1978 home we are renting. Landlord performed renovation without being certified to disturb lead surfaces. Exposed lead paint has been found on home. My wife has been pregnant while we have lived in home. Landlord has illegal late fees for the state of Oregon. Can I break my lease and sue my landlord for the illegal late fees in contract (have not been charged fees)?
 
I wouldn't advise you to break your lease.
You are free to take it to court and tell it to the judge.
 
Civil lawsuits are about damages that, typically, result in some sort of financial issue. Even if the lease contains what you believe are illegal late fees, if you've not been charged these, you haven't suffered any financial damage.
