Overspray on Vehicles- Please Help!

Hello,
New to the forums, and wanted to discuss with everyone a situation that has arrived involving myself and my coworkers.
I work at an auto parts retail store, across the highway from a company that does metal fabrication for mining equipment and railroad equipment.

The past few weeks they have been painting outside with industrial paint, and high pressure paint guns. There is normally a breeze blowing across the highway that has resulted in an obscene amount of overspray on 7 personal vehicles, including my own, and our company delivery truck.
The overspray encompasses our windshields, making it difficult to see if the sun is shining, or headlights shine in our windows, and it has basically ruined our paint jobs on our vehicles.

We have attempted to resolve this issue with our across the highway neighbors several times, and they keep putting us off each and every time. We have also asked them to stop painting outside, because the paint is getting on our building, our vehicles, and almost certainly our customers vehicles. However, they continue to paint outside almost each and every day.

With my long backstory out of the way, my questions to the forum are:

What legal or civil action can we take in this matter?

Is it not illegal to paint outside, with high pressure paint guns? (we are next to a river and a lake)

The company I work for is a national chain. Is there any liability on their part?

And finally, if we take action againt our neighbors, can their be any backlash on myself and my team members from the company I work for? (such as termination of employment, etc)

Thank you so much for your help!

Dave

The company that owns the building can sue for damages and an injunction based on trespass and nuisance. It is their call.

Individually you can sue for damages. Start by getting an estimate on buffing off the paint and send them a demand for payment. In a similar case I had about fifty cars done at 100 a pop. The spray is dry by the time it gets that far and usually comes off very easily. Send it CRRR. If you don't get a reply, take pictures and have it done and sue in small claims.

Usually you are an at will employee and can be fired for any or no reason.
