Alcohol & Drugs: DUI, DWI OVI charges

I have been charged with an OVI, i refused FST. Officer states odor of alcohol. I have several prescriptions from this year due to recent knee surgeries, can i use this as a defense even though they were not on me at time of charge.

If you are stopped for drunk driving and you refuse to take the sobriety test, or if your test results exceed the legal limit of Blood Alcohol Concentration (BAC), the officer can take your driver's license on the spot, and the suspension begins immediately.ALS for test refusal = one year license suspension. I quess you refused the test at the station also??? Refusing the one in the field is ok as long as you took the one at the station. If you did not take either one which it sounds like you did not then your answer is no. Get an attorney and he/she can get the best results to the conclusion to this matter. good luck.
 
The pills do not explain the odor of the alcohol and other signs of intoxication. That excuse won't stretch far at all.
