Hello
I'm a subcontractor owed the retainage from a contractor on a job done at atlanta airport. The contractor lives in TN., I felt as though he would pay even though it's been a year since job completion. Our last verbal conversation was that he went through a difficult time and had to use the money for personal. All attempts have failed to receive payment What are my options, The amount owed is 850.00.

You can forget it, or you can sue for the $850.
If you sue him, you'll probably have to sue him in TN.
You can potentially make a case for suing him in small claims in GA, in that he did the work in your state.
But, for $850, it might end up costing you more than you can potentially collect.

The problem with small claims cases is that you often prevail, but never collect a dime.

So, after all the effort and money you shell out to bring the case, you rarely collect anything.

You between 4 to 6 years before the SoL tolls in GA for this kind of debt.

I would like to take him to small claims or at least try. I do want the case in GA with the contract signed here and the material and work done is a permanent feature here in atlanta. What I do not understand is if the judgement is in my favor how could he not pay up without being in breach of judgement. Doesn't that carry some fine?

Most people who lose small claims judgments don't pay. Why? Too many reasons to list, except to say, no one cares except the plaintiff. So, it's your job to TRY and collect what is owed.

The court got it's cut, why should it care?

It's your job to try and collect.

Plus, he lives in TN, so suing him in GA is impractical and all but impossible.

Read the links, do more research, your eyes will be opened.

Government doesn't care about much, except stealing our money and making sure we obey them.

Fewer than 10% of those judgments are ever collected, some people say fewer than 5%, lets agree the amount collected is small.
