Child Support was ordered in December 2007 to pay 242 a month. He never onced paid for support. He now owes 6400 in back support. He has been in and out of jail, but only for about 4 months of the past two years. Now he filed a motion to amend the order, because he has no job. But he never even attempted to make payments on this. Will they amend the order? Or throw him in jail??? He is also on probation from previous offenses. Also, will any of this back support be reduced because of him amending the order???

Probably not but it depends on what state. Most states will input an income for him if he is not working. $242/mo is not a lot in support as it is. Some jurisdictions will suspend his license and eventually he may go to jail.

No reduction in back childsupport owed

It is highly unlikely that they will reduce child support that he already owes and has not paid. Duraine is right that they will impute income to him for what he should be making with a job. I doubt they will lower his child support. He could go to jail and he probably doesn't care much. I hope your current significant other is a better choice. Sorry.
