I recently bought a truck and I got a loan through a credit union. The dealership sent me the title by mistake and not to the credit union. What am I required to do legally. Do I have to pay the loan if I have the title of the truck??

Why on Earth would you think that you do not have to fulfill a legal and binding contract??

You have a contractual loan agreement with the credit union ... if you do not fulfill the terms of that loan (i.e., PAY them), they will have good cause to sue you and probably even seize the vehicle.

Save yourself a lot of embarrassment and expense, PAY the loan that you agreed to.

I understand that, but how do they "prove" I didn't pay them if I already have the title for that vehicle in my possession?

Oh, that nasty little thing like checks, receipts, bank records ... you know, the paper trail you will have to produce to show you paid it off when they sue you.

You CAN'T be serious! You REALLY think that a paperwork foul-up like that is going to give you a free car!?

Go ahead and give it a try ... I hope you have money for attorneys, AND to pay THEIR attorneys ... as well as the balance of the contract.

OK then, what is my legal responsibility since I do have the title. Do I legally have to give it to the credit union?? I am paying the loan I was just wondering what I had to do legally since there was the foul-up with the title. The credit union sent me a letter and an unpostage return envelope for me to send the title to them. I was upset that they expect me to pay the postage when the mistake wasn't mine. The other stuff I was just messing around to see if I could take advantage of the dealership's mistake.
