So this car was paid officially in November 2013 and it was under this person's name. The title came to me under the person's name and we only had a verbal agreement. Not only that but they agreed to pay a car that was reposed and I continued to pay for this car until it was paid off. Now not only does this person want to take over this car but also defaulted on the loan that was under my name. What legal recommendations do you advice I pursue? This person in particular has also made a police report stating the car was stolen. I have all the paperwork with payments showing my name and card digits sent to the company that provided the loan. I also have the loan paperwork for the loan they defaulted on. So to sum it up it was a verbal agreement between two friends, I would pay his car and he would pay my car, he defaulted on my car and lost the car to repossession. I on the other hand paid his car completely and now he is threatening to sue me to get the car back. This is completely ridiculous and I know that there must be a way I can sue back for both falsely accusing me of stealing the car and secondly for defaulting on the loan he promised he would pay.

I'll be gentle, you were conned.

If you paid for the title, while it was in another person's name, they own the car.

In a perfect world, they'd have signed the title over to you, BEFORE you began paying on their note.

That didn't happen, and your payments have resulted in your GIFTING them the car.

If it wasn't in writing, it never happened or was said!
