I have a 6 year old with my ex-husband. I am remarried and my current husband wants to adopt my daughter. Her biological father has not seen her in 3 years and the only reason I get child support because he is in the military and they automatically take it out. We live in the same state (georgia). He never calls and talks to her and never attempts to see her. We have asked him to let my husband adpot my daughter but he no just to spite us. Is there anyway around this?

If he has made no effort to contact the child in three years you should have grounds for abandonment. Contact a Lawyer and how to begin

Actually, payment of child support is considered contact.

Payment of child support is absolutely NOT considered child support. I live in GA too. You can file to terminate his parental rights if the situation is right. I don't like to get too deeply into juvenile cases on the web, but tell me more about it.

Support is actually a form of contact, in most cases. Abandonment would not apply here since the father is supporting the child. So at this point you can continue taking the money and him have no realtionship or maybe if he knows that future support will stop, he might be willing to do this.

Bear in mind that the rules for Mom to successfully TPR are NOT necessarily the same as those which would apply if the State was seeking TPR. In this case, because Dad is paying child support and it's NOT the State who are trying to do the TPR, it would appear that cyjeff and Duranie are correct. CS will most likely be considered contact.
