Parents House

My brother is losing his house due to poor financial management/mooching over the years. He is thinking about moving into my parents house which is up for sale. My parents are in a nursing home . There is no mortgage on the house. Can he legally move in? I have power of attorney on both parents. Help me please before he gets a toe hold! Thanks. Any Advice?

Make him sign a lease agreement if he moves in. If you prefer him not too then tell him you have POA and je is not to move in, honestly I would change the locks.

He has no legal claim to live in the house. He can legally move in if the owners (your parents) or you (their agent), permit him to move in. I imagine you would want to confer with your parents to see what their wishes are. What is your parents' estate like? They might consider advancing the home to him as his share (or part of his share) of the inheritance.

Selling the house will be impossible if you let him move in. Probably almost impossible now so don't make it any worse.
