So first of, let me say Hi! Im Chris, Im an aspiring pre-law student and my family friends need help.

The story is laid out like so,

My friend, lets call her L, is the youngest of 2 daughters, she is 16 her sister is 18, their parents were away for 9 days. They threw a party. Obviously alcohol was involved and such.

One young man, Who is 18 and graduated from high school, drinks too much, and passes out. Everyone then deicdes to help him out take care of him etc...

He then came to and began to bad mouth everyone, within a few minutes he again promptly passed out. Angered by this, some boys drew on his face, as customary at teenage/young adult parties.

The young man awoke to find himself marked, and threw a fit, breaking several items in the house.

Upon their return my friends parents find the items, confront L and her sister, and call the boy. They ask for money to compensate for the damages, he agrees.

Moments later his mother calls, threatening to sue L's father for emotional and physical damages (the marker) and she calls the cops.

Now L's father is possibly facing a court date, BUT FOR WHAT?

Any ideas guys? An adult was left in charge of the house, sure they were all under the drinking age, and it was the fathers liquor, but he wasnt there handing it out.

Also the boy is 18,does the mother even have a say anymore?

COuld L's father recieve deliquency of a minor?

Thanks guys

What state?

And I doubt that L's father can be successfully prosecuted for this, though he might be able to be sued for something ... not sure what.

If he has a court date, he has been noticed as to what it is for. If he reads the subpoena, summons, or citation, it should state what the offense is and whether it is for a criminal violation or a civil matter.

I doubt a court is going to concern itself too much with the consensual acts of 18-year-old adults, and I can't imagine that anyone can be charged for those consensual acts unless there are some details being left out.

The state is Colorado

and that should be every detail, he may still be under his parents care but he is 18 years old and graduated.

Also he wasnt an invited guest to this party, he kind of showed up.

Im not sure there is a court date yet =D Thanks for all the help.
