I recently found out that one of my co-workers was offered a promotion that I wanted to apply for. The issue is the job hasnt even posted yet and she was offered the job behind closed doors with the big boss. She was told to keep her mouth shut until the postiing is closed and they will then promote her. I want to sue my company for damages once the promotion takes place in 3 weeks! Is this something I can do and if so can anyone help me?

There is no law requiring private employers to post jobs at all.

Short of a union contract or is civil service position rules in a government entity, the employer can promote/hire anyone they want, whenever they want, as long as the job action is not based on a Title VII-protected characteristic, such as age, gender, religion, etc.

You have nothing to sue for. The employer did nothing illegal. Besides, how do you know you would have gotten the promotion? You don't.
