To make a long story short the road I'm traveling on is a two lane road one going down and one coming out double lined. Here is my situation I was on my way back from my lunch break and there was a mail courier in front of me as well as a city vaccum truck. The mail courier pulled to the right I cautiously went around him and then the city truck decided to sit there in the road. So I cautiously was going around him and then he hits me on my passenger side in the rear end. There was no one coming on the other side for him to stop in the road and he did not give a signal. I called 911 they got the police out there and the cop asks me what happened when I hit the city truck I told the officer I did not hit the city truck and that he hit me. The officer was trying to get me to confess to hitting the city truck when I swerved and he still hit me. At this point I feel like it is the city against me. The officer is charging me with passing over the double line. Then the officer says you don't have to show you can just pay this ticket. Is there anything that will help me out when I go to court? Like the city worker being an obstruction in the roadway or anything.

You did not post your state, or the section you were cited for, so it's impossible to say whether the ticket might be defensible or not.

In general, you are unable to pass to the left within the same lane as another vehicle or cross over a double yellow line in order to pass. So, passing the city truck on the left might have been unlawful even if it were slow and cheating toward the right.

Contact the police department and find out how to obtain a copy of the collision report. Also contact your insurance company ASAP and let them know about the crash just in case the city makes a claim.

I'm in VA. I don't have the code I was cited for I just know it is crossing over doublelines. I had already alerted the insurance company and everything. I am just wondering if there was anything I can do in preparing myself for court to represent myself.
