My boyfriend and I live in South Dakota. His ex-girlfriend moved to Nebraska after they broke up. The ex-girlfriend had a baby 3 weeks ago and the whole time she was pregnant she was claiming it was his. He claims it isn't his. What will he need to do to get a paternity test even if she refuses one?

Your BF would need to file for paternity in the state that mom lives in. He MIGHT be able to file a paternity action/support in HIS state...Have him consult with a GOOD family law attorney to see it the statutes would allow this.

Custody matters would be in the home state of the child.

BTW: It is in BF's best interest to determine if he is the father right away...If mom is getting State assistance he could end up with HUGE arrears owed to the state. Better to determine paternity/support/custody sooner rather than later.
