Pay rate changed after interview, lied to me.

Hello.

I started a job about a year ago - that has turned about to be nothing like what I was told.
After going through two interviews with the company I was called to be offered the job. I submitted my resume for a job that had a compensation rate of 38k - 50k per year(about 25% less than ind. standard).
When I came in for my first interview, I filled out an application and stated I was looking for the 50k comp. rate.

In my interview I asked about the organization. I asked if it was a non-profit(it's a local MLS realty listing co.). The VP in the interview stated they were definately a 'for profit' company.
I also asked about the company structure, mentality, management styles, etc. - I asked a lot of Qs....

The day after my second interview. The HR person contacted me to offer me the position. But stated the posted an incorrect pay rate. And offered me 42k per year.
Since I was on Unemp. Ins. I couldn't decline the offer, as they knew I was on Unemp. Ins. and I was afraid to lose it if I denied the offer.

After a couple weeks I found out the pay rate was not a mistake in the posing. But that a less qualified QA staff member threw a fit with management and the VP because the rate was so much higher than what he made(my manager admitted this to me). As well, the project manager also verified the happenings.
So now, i've sat here for a year with this burning me up. The coworker that impacted my hiring rate has now left the company.

On top of this, I found out that the company is not in a non-profit status, but is owned by a non-profit - which I was not told about.

After I just received a glowing review - and a belittling 2% raise. Not to mention finding out that my manager has no formal qualifications, and 10% of the job experience I have. My coworkers are mostly visa workers that barely speak english - and I've been given most of the work load since I can communicate.

My questions are;

Once a job posting with compensation rates is made. Doesn't the company have to repost the job again with the corrections before offering someone the position?

And, if someone inquires if the organization is a non-profit, wouldn't they be required to inform the person they are a asset of a non-profit?

Since the coworkers 'fit throwing' caused my compensation rate to change, do I have any recourse on him, or the management?

I can say, if the job was reposted, I wouldn't have applied for it. If I wasn't on Emp. Ins. I wouldn't have accepted the position either(as it pays less than half of what I was making...).

Thanks for letting me vent - and post.
Best regards.

Sorry, but the answer to all three questions is no. They are under no legal obligation to post the position at all, let alone repost it with corrections if the requirements or the job elements change; they have no legal obligation to tell you the profit/non-profit status; unless you had a legally binding contract guaranteeing you a higher compensation rate you cannot take any action against anyone for the change.

The above assumes that the position is not under a government contract or is an arm or agency of the state, Federal or local government, which might change some of the answers.

Thank you.

You have a great site here. I've enjoyed reading other postings and responses. Makes me want to go to law school...
