I took out a payday loan in Ohio and could not fulfill the debt on the date (1/4/08) I was scheduled to repay. Subsequently they took my checks to my bank and they were supposedly returned NSF. I began receiving phone calls from the loan store last Friday (1/4/08) and they left me several messages to return their calls. I had been in and out of the hospital for a few days (I'm pregnant and having complications). I couldn't return the calls during their regular business hours, so I left a message on Monday (1/7/08) explaining my situation. I received a message that very day saying that the loan store had called local hospitals to see if I was actually admitted to the hospital. I had not been, I was only there for long periods for monitoring and tests. Can they legally call hospitals asking for me? Well, I wasn't able to return the calls and on Tuesday (1/8/08) the loan store called my boyfriend's mother to ask if I was in the hospital!! I never listed her as a reference or contact, but had casually mentioned in a previous conversation that she was my boyfriend's mom!!! They used that information to find her work phone number who then in turn gave the loan company her private cell phone number. Doesn't this breech privacy? Also, when they call they block their number. I spoke to the manager today (1/9/08) who said that because I had been delinquent in the past he wouldn't have even given me the loan. Ok, so why wasn't my account flagged for that? He also charged that I was committing fraud by intending to not pay back the debt and not communicating with them. He also threatened to turn my account over to the police. Is that reasonable? I requested for him to start formal collections against me and asked for him to send a letter stating the debt. I said I would then fulfill the debt with a money order. He said that it was not their policy to send letters, but rather they only called people to collect. He gave me until this Friday (1/11/08) to send the money order to the store after I told him I didn't wish to step foot in the store ever again. Please tell me there is something wrong with this? I know I owe the money and I will fulfill the debt, but I'm currently pregnant and could literally have the baby any time, especially with this kind of stress hanging over me.

You need to understand that these types of business prey upon people who have bad credit. These business make millions of dollars over the year by charging very high intrist rates.
I am not surprised at their tacktics on you. This is how they get quick responses from people. They try to scare the hell out of you threatning you with the police, court, and talking to other people of your debt.
You do owe the money! but, they can not have you put in jail for this debt. I would start by sending a certified letter to that person you have been talking to stating that you no longer wish to be contacted by phone, or in person. How can he prove you wrote that check and had no intention of repaying the debt? DOES HE READ MINDS!
He could try to say you wrote the check knowing you didnt have the funds to cover it, but.........Ofcourse you didnt have the funds at the time and that is why you were there BORROWING money!
Don't let these people scare you....Thats what they want to do so you will run down there with your head tucked down and repay the debt.
