My jurisdiction is: Riverside County, California

For about 14 years I have been collecting rent on a condo owned by my son. I also send the payment each month that is owed to the Lender who has the mortgage on the property. Now the renters are not paying and my son is out of work. I am retired and not able to make the payments. I am only 2 weeks late for the first time making the payment to the lender.
The lender started calling me but I am not able to make the payment and neither is my son unless we collect from the renter.
My question is: Am I legally liable to make the payments since I am the one that has been sending them in each month for such a long time. Can the mortgage lender put a bad mark on my credit report. I have not become a co-signer or anything else on the mortgage. I just made sure the payments were made on time for the last 14 years.

No they cannot since you are not on the mortgage. They should be going after your son. Unless there is a document tying you to the mortgage, they cannot ruin your credit.
