After almost 10 months of working for my employer, I have never received a 90-day review. When I was hired, I was told in the interview that I would receive a 90-day review and the offer letter I signed also stated such. During my employ, it has been a matter of record that I have two bosses - the Vice President (secondary boss) and the CEO (primary boss). The Vice President and I get along very well and have a positive working relationship. The CEO and I don't get along at all, we can barely stand to be in the same room with one another. From the onset of my employment, I have been reporting to the secondary boss, providing updates, holding meetings, feedback reports, etc. I report and communicate very little with the CEO/primary boss and this practice has been established by him (he is not a people person/very poor communication skills and rarely replys to emails that I send him).
The CEO/primary boss got word that I have been looking for other jobs and planning to quit. In a recent meeting, he gave me some insights into what NEGATIVE comments will be in my evaluation which surprised me to say the least, since he has never mentioned to me that he was ever displeased with my work. My strong suspicion is that this has become personal. There were strong overtones of emotionally-based charged comments from him that in my opinion were trivial and ladden with 'get even' as well as retaliatory actions on his part in regards to my upcoming review. The conversation finally ended abruptly with us concluding that we shall mutually agree to terminate the employment relationship with a target separation date of my employment within 30 days. We agreed to both sign an agreement letter to this fact and did so yesterday (7/27/11).
He still insists however, that we need to still have the performance review session prior to my termination.
I DON'T SEE THE POINT OF DOING ANY SUCH REVIEW! My concerns, which I told him is #1 - I never received a timely 90-day review; #2 - I have been reporting to my second boss regarding my work and I feel that if anybody should conduct my review it would be the second boss, he should have input into my review or at least partial input, not solely the CEO; and lastly, #3 - the company has a very poor history and track record of even doing employee evaluations! There are a number of employees who have not been reviewed in over two years or more. Now all of a sudden, the CEO is in a rush to do my review when I have been repeatedly asking for a review for months to no avail. I feel that the CEO is not capable of setting aside his personal feelings and give me an unbiased, impartial, and fair review... I don't trust him to conduct a proper and accurate evaluation of my work without letting his personal emotions get involved.
Since I am terminating my employment in 30 days anyway, legally can he make me participate in the review process. I told him that I refuse to sign anything that I felt or perceived was retaliatory. Also, our agreement letter doesn't indicate any demand or contingency that I must still receive the review. Please HELP!
