A few weeks ago I submitted an application online for a major retail store chain. I was called in for an interview and things seemed to be going well. A day or so after my interview I was contacted by a person from another county in my state who informed me that while picking up an order at her local chain my application was printed out and given to her with her order packet. She has since mailed me the application. I called the store and spoke to the manager and he told me he would get back to me but ended the call with out even taking down my contact information. I called the corporate office and after explaining the problem I was told they would investigate the issue and be back with me in 24-48 hours. About a week goes by and they did not get back to me. I called them again and I was told that they did not know why I had not been contacted and that the matter had not been attended to so far. I was given a reference number and told I would be contacted in 24-48 hours. Once again I have recieved no reply. I am concerned not only by the fact that they do not seem interested in geting back to me but that personel information could be printed out at a register by who knows who. I have contacted a personel information protection line and they gave me some helpful information but I am still unsure of how to proceed. I was direct to a civil law that if I am reading it right says that in the event of a possible security breach they need to inform the person involved. (Civil Code section 1798.81.5.) and (Civil Code sections 1798.85-1798.86). I have had run ins in the past with someone using my information and as of now I do not know where I stand with this company and my personal information. Please help. thank you

The only way you could prevail is IF the store admitted to this alleged error.

You seriously don't think they'd do that, do you?

Sure, they could, but I wouldn't bank on it!

You have noticed how rapidly they've addressed your complaints, haven't you?

More importantly, however, is that YOU would have to PROVE how this happened.

The store can simply deny they had any part in this fiasco.

They could postulate that you and the other party were in cahoots to burn the store.

Yes, I agree, that's silly.

But, so is your assertion that the store had any part in this matter.

There are several other scenarios that could explain how the lady giot your application.

That, my friend, is reasonable doubt.

All this makes it difficult for you to prove beyond a preponderance of the evidence that the store was in any way negligent in regard to protecting your data.

But, say lightening strikes and you do the impossible.

What were your damages?

Fortunately for you, there were none.

You can't recover based on what might have happened, only on what did happen.

So, you prevail and get a judgment for one US dollar.

As my dad was wont to say, "even when you win you lose".

I thought as much. I am up the creek without a paddle. With the print out I have the time and the stores name so that should prove who and where the breach happened.there really is no harm done so far. I am not interested in a claim that would get me any sort of dollar ruling I am more concerned about the security of my SSN. One honest person called me but how many others got my information and that is what makes me uneasy.
 
You don't have to wait for the store to admit anything to contact the three national credit reporting agencies and have them flag you as a possible victim of identity theft. Do that NOW.
