My sister who is 24 just got cought at Walmart in Sand Springs for switching tags on merchindise to make the prices cheaper!! She bought the merchindise but it was not the correct price. They gave her a ticket and it said petit larceny! What is going to happen to her? She had a ticket in CA but hse never attended the court date. Is that going to show up when she goes to court? What should she do? What faces is she charging? Do you think that she wil do jail time?
 
Your saying she has a failure to appear on her record? If thats caught she could be arrested right there at courthouse. She needs to talk to a lawyer to plan both her defense for the theft and for the failure to appear if its found. It is odd that Police did not find it at time of her arrest so thats a good sign. She should talk to a Lawyer before she steps one foot into that courthouse. Is this offense also in CA? (California I presume)
 
Long as the warrant doesnt show up on OK when court runs check she should be fine. Its not likely she would be extradited for a traffic offense however finding this could impact sentencing. She needs to talk to her Lawyer and discuss her options. Hopefully she still qualifies for Diversion

She doesnt have a lawer! She is a mother of 3 and neither her nor her husband are working so she cant afford one.

Yes and no the court will likely do a more through check

Then she can ask for Public Defender

These programs vary and are not available everywhere. However in general they work like a conviction with fines, community service etc but once you successfully complete program your case is "dismissed" meanng no conviction record


Side note:
Just because she cannot afford an Attorney does not mean she cant talk to several. Tell her to start calling Lawyers see who offers free consultaions. Get as many as she can and pick these Attorneys brains so she walks into court with knowledge
