My brother's arraignment is on Monday 11/10 here in California.
He already paid the civil demand for the store 2 months ago.
He is very scared for his court date.
Our question is....Will the court stick to the report that was given by the
police officer. Will his immigration status be checked along the way?
He is still in petition as of the moment. Hoping for your feedback on this.
We just want to be sure that he will just be in court for the petty theft ticket that he has. Hope to hear any feedback soon.
Thank you.

The arraignment is not about "sticking" to anything. The state will read the charges off and he will have an opportunity to make a plea and ask for court appointed counsel if he cannot afford his own attorney.

If it goes to trial, it will be the officer's testimony (along with other witnesses and evidence) and not the report that will be used against him.

Will his immigration status be checked along the way?
Maybe.

We just want to be sure that he will just be in court for the petty theft ticket that he has.
Why wouldn't he be? Are there other crimes he has to worry about?

Your brother should be talking to an Attorney with is familar with both criminal law and imigration law. A conviction could effect his status here
