My jurisdiction is: Adams County, Colorado

My children and I were with my mother at a store in Adams County Colorado, she was caught shoplifting, petty theft, but has many other warrants and charges in the County for the same thing. The authorities arrest my mother and then the police gave me a ticket even though I was not stealing and did not have any merchandise on me.

My court summons/ticket states the following: theft and child abuse (on only one of my children that was with me at the time, the youngest). I have never been in trouble before besides a domestic violence call in which I placed a temporary restraining order on my ex-boyfriend (the child in question; his father).

I was not taken into custody and I am scared out of my pants. Will I get a plea deal if I say I was guilty? Do I plea not guilty and move forward? Moreover, will I serve time and/or children taken away from me?

Please advise,
Sharmaine

The way it works is at arraignment you plead not guilty. If you can't afford one, you can ask for an attorney. If you can afford one, you should get one as soon as possible.

I don't understand how or why you are accused of child abuse, could you please elaborate?

The Police officer said because I knew what was going on and I had my children with me. My ticket isn't written out very well, but when I called the Adams County courthouse they said that I was charged with both theft and child abuse? Can I call and ask for the Officers Police Report? because I am still very unclear about why I am being charge for that as well?

Technically it is abuse or endangerment when someone associated with you is committing a crime and you do not remove the kids from the situation. your mom is troubled and it is not good to expose her to the kids if you want to keep your rights. You might be able to get this charge dropped with an attorney.

Duraine is correct. Your poor choice of shoplifting was bad enough but when you do so with your child CPS can get involved. This is very serious. You need to consult an Attorney right away! Even if you cant afford an Attorney you can still meet with one. Many grant free consultation. Take them up on that and if you go the Public Defender route you will at least be informed.
