I would like to know what a maximun sentence would be for this offense P.C.666.

My friend was arrested for petty theft at a local Wal-Mart. the merchandise was less than $50, but she has been arrested for a similar offense back in 2001 with no priors until now. The merchandise cost was less than $100.

What type of sentence is she looking at?

Is the second offense considered a Felony? if so what degree will it fall under and what will be a likely sentence? or will it be just probation?

Would be better for her to stay in jail or post bail? The toal bail is $1,500
This offense happened in San Bernardino Co.

He can do local time (county jail) up to a year or prison time up to three years. An attorney might be able to negotiate a deal for little time and probation instead.

666. Every person who, having been convicted of petty theft, grand
theft, auto theft under Section 10851 of the Vehicle Code, burglary,
carjacking, robbery, or a felony violation of Section 496 and having
served a term therefor in any penal institution or having been
imprisoned therein as a condition of probation for that offense, is
subsequently convicted of petty theft, then the person convicted of
that subsequent offense is punishable by imprisonment in the county
jail not exceeding one year, or in the state prison.
