If I got arrested for a second petty theft but the first one was 16 yrs ago, can it still become a felony? I was 18 and now at age 34 got another petty theft. Also if I am pleading not guilty, what are the chances of the judge granting me a Diversion program or probation ? Will my past affect this?

You are at the mercy of the District Attorney. It could go either way.
If you have had no trouble for nearly 20 years I would expect some leniency. If you have been in and out of jail for other things you may have a bigger problem.
Lawyer up and decide on a plan of action.
