I have a friend that is not yet divorced from his wife. She has a very dirty past, she is constantly going in and out of therapy for mental problems. She has also tried to committe suicide 8 times for the years that they have been together. This past weekend she did it again and actully almost succeeded. She have to be life flighted and revived. She had taken a few bottles of pills. Instead of admitting her for evaulation or for inpatient help they released her today. What can he do to protect his 4year old daughter. They have a custody agreement set up were the mother gets visitations but hardly ask for them unless she can show off the 4year old..what can he do to protect her?

Unless he can prove that she's actually a harm to the child (such as - can he PROVE that she attempted suicide in the child's presence? At least once or twice?), Mom is still entitled to visitation.

Even if Dad can do that, at best he can hope for supervised visitation.

A PFA is not likely to be ordered in this situation.

ETA: He may be able to file an ex parte motion suspending visitation until Mom gets a psych evaluation; but again even if that goes ahead the likely result would be that Mom's visitation is supervised.
