If someone gives me a phone but it is under their name, however it was given to me for my exclusive use. Does this person have a right to examine the text msgs
without the my permission? Or are they illegally invading my right to privacy?

Just give them back the phone, and pay for your own.

That way, you avoid anyone even asking to see your text messages.

Of course they can see your text messages, and they don't have to look on the phone to do it (for most companies).

The person gave you the phone to keep an eye on you.

Give them back their damn phone and break the chains that bind!
 
If they gave you the phone you are not obligated to hand it over for inspection... however the owner of the phone will have access to the phone bill and will see telephone numbers called/received/texted, but not the actual messages.

Exception: If you are a minor (under 18) and this phone belongs to a parent who has allowed you to use it- Yes, absolutely the parent has access to that phone as well as everything else you might think is yours.
