I was robbed by a dealer that stated he has pictures of me using drugs, SMS messages and recordings. He is threatening to turn them over to the police how should I deal with it. I have to do a sworn statement with the police because a report was filed for the armed robbery.

Pictures can be altered, so can messages.

I would take the fifth, if the issue of the pictures, recordings, or messages is discussed.

You do not have to incriminate yourself.

So, do not speak about these allegations to anyone.

You should speak only about the robbery and relevant events that surround it, when you speak with the authorities.

Anything else you should consider off limits.

You should also inform the prosecutor (and the police) that the alleged robber has made contact with you and is trying to intimidate you from testifying against him.

Such acts are illegal, as they are serious felonies.

Going forward, have no more contacts with the alleged robber.

Make a record of any and all contacts he attempts to reach you.

If you get voice messages, forward those recordings to the prosecutor and police.

One more note, if you have been using drugs, STOP.

Get help if you can't STOP on your own.

As you see, things do get exposed when you least want them to come to light.

I would stop doing the drugs, keep my mouth shut about the pictures if there are any, and stick it to the drug dealer as hard as I can. He is bluffing.

These can be amusing cases for the cops as we often end up arresting all parties. Yes, the other guy may be bluffing, but if he goes down for the robbery and spins a tale of the OP owing him money for dope or some such thing, then the cops will turn to look at the OP. In the end they could very well both go down ... it would not be the first time, and it would not be the last.

If our OP has not done the things alleged, then he has nothing to worry about. If he has ... oops! Time to change careers or, next time, write off the robbery as a cost of doing business.

I'll bet those are amusing cases, you have the pot calling the kettle black and all parties concerned go to jail. Wow..

Pictures of you using drugs will not hurt you. The only thing that will hurt you is if you are found in possession of contraband or if you are under the influence when you have contact with police.
The threat is empty. Don't worry about it.
