Since the initiation of the new campaign to "click it, or ticket," I have received two seat-belt tickets (CVC 27315-d-1) within a month of eachother.

I do not generally wear my seat-belt because--when fastened--it crosses my body in such a way that when I turn my head to the left it hits my chin and even obstructs my field of vision. What I'd like to know is whether this a valid argument in court (I could bring pictures in showing how obstructive it is), or should I not bother?

Also, is there a rule that the issuing officer must follow my car for a certain amount of time before pulling me over? In one of the cases, the officer hadn't even finished pulling into my lane behind me before sounding the siren.

Furthermore--assuming I do go to court--is it possible and/or wise to ask the judge of the first court date to rule on both tickets so I wouldn't have to come to court a second time?

I really appreciate any input on these questions. Thank you.

Another question

In both of the above cases, the officers asked "Did you just forget to put on your seat-belt?" It seems suspicious that both said it exactly the same way. I answered affirmatively in both cases as if the answer was self-evident, given that my seat-belt wasn't on. Was saying yes to this question an admission of guilt, ie, would it hurt my argument that wearing the seatbelt is obstructive?

Thanks again.

If you can't see when wearing the seat belt in your vehicle or the seat belt obstructs your vision because of your height or lack of mobility in your neck (I am not sure which in your case), then go to your doctor and have him write a statement that would allow you not to wear your seat belt. It is kinda like getting a handicap letter for a seat belt. Keep it in your vehicle at all times so when you are stopped you can show it to the officer.

You can contact the recorders court before the court date to try and reset both court cases on the same date.

Take the letter from your doctor to court and show the judge. He/she may or may not let you go because the letter will be dated after the citation date.

Good luck!!
