Please help if you can

Hi I am new here.I think I posted a legal question message in the wrong forum. I apoligize.Anyone,my brother was recently served with legal papers.He is being sued by a credit card company for over 1,400 dollars.That is just about what he makes on his next check.He's a schoolteacher.He is in debt, but will pay the bill with his next check.As you can imagine,both he and his family[my mom and me] are very frightened.He can pay the bill but we are not sure he can pay court costs.What should we do about this? Please any advice you can give will be helpful.Thank you.

Best bet is to work with the credit card company. Be prepared to be very specific. Agree to settle with them for a specific amount paid by a certain upcoming date. Do not tell them where you are working only that you will be able to have sufficient funds to pay. If they do end up going to court to then heap on top of that attorneys fees and other collection costs, then tell them that you will challenge them in court because the fees are not reasonable any more. One reasonable adjournment -- which you might even be able to request yourself -- will solve this whole problem. They have nothing to lose and an extra 2 weeks or month won't make any difference and they have everything to gain. MAKE SURE that if there is an adjournment done by you that the attorney is notified. He is supposed to notify his client. Otherwise if his client agrees on the phone, then send a letter, certified mail, to the attorney and the client documenting the agreement.
