my daughter is 22 years old with a 9 month old son ..she and the baby live with the babys father but they are not married, He has asked her to move out but says she can not take the baby, we are not sure where we stand on this or if she will get in trouble if she takes her son, could someone please let me know how we should deal with this ?

Was paternity ever established? If it has then technically both parents has rights. She can probably move out and take the child but she should file for custody. As long as she remains in the state and does not move too far, I do not see where there could be a problem.

If paternity has not been established, meaning he did not sign the birth paperwork, then Dad has no rights at all.
