I am faced with a terrible problem, today I received a letter from our corporation attorney terminating the proprietary lease of my co-op (nyc), but first let me rewind a bit and explain, I have been living in my Co-Op for approx 15 years. There never seemed to be a problem during most of this time, about a few years back the management company changed (approx 5 years), ever since then the managing agent has always seemed to have some hatred towards me for no reason. Two years back a new neighbor moved into the upstairs apt his description about 6'2 over 200lbs along with his family. Take into consideration I am only a middle aged 5'1 female, now ever since this person has moved in there has been constant hammering on the floor, sounds like heavy objects dropping, the sound of pitter patter all around the apt, sound of heavy running all times of the day. All first I thought it would go away, but it didn't it just got worse. I tried to tap on the wall one time to make them aware that the issue was getting out of hand and was returned with a reply of heavier pounding. I immediately stopped, soon after there was a hard banging on the door yelling asking me to come out and speak with him, ringing of my door bells with no one there when I came to check. To me this person seemed insane. I was called names through the door some of which felt a little racist as I am of Asian decent. The worst part about this is that this person was currently serving on the board as well, fresh elected and had just moved in not only a few months ago at that time. Needless to say, this harassment never stopped, it was folled by constant letters underneath my door with some of the most outrageous claims. I called the building attorney but they always sided with the upstairs tenant as they where part of the board, was met with sarcasm whenever I called. Even letters (which I 'dont have anymore) sent to the board never answered. I received a few letters from the attorney to cure a objectionable smell at one time? But I never cook any food with strong odors, another smear or racist tactic by the upstairs board member, also they claimed I was harassing them in the night by banging on the walls, which I never ever did, but yet they pounded on the floors day and night (assuming that was the reason so they could live like this), there was even an inspection of my property by the building attorney then was told there was nothing I could do, although I can tell that they just wanted to see inside my apartment due to the lies that were spread by the agent and that board member, I was then told there was nothing I could really do and that the tenant was moving out and to bare with whatever the issue was until they left, which I did, now its funny how the new neighbor, same family style, same aggression moved into the apartment, same noise, first day I politely went there, and was met with sarcasm and was given like yea yea attitude, second time I went there was several days ago to notify the upstairs that there bathroom was causing water to flood into mines. The second day I received a letter from the attorney with no reason what so ever, it just mentioned paragraph 31 etc… that my lease was terminated due to objectionable conduct and must remove my items and leave within 5 days. I honestly don't understand, I have cried half the day and the other half worrying, no one listens to me in this building and its hard to communicate with them, I have never acted objectionable towards anyone, I have never caused a scene, made false claims, sued the building, I have always minded my business. Can please someone help me understand what is going on. I will seek an attorney advice tomorrow but honestly I can not rest nor sleep, please someone help me, and what can I do to prevent this?
