We signed a Real Estate sale and purchase agreement last year in Texas for our house. The buyer agreed to take over payments and assume the loan. He has not. The payments for the home have been late every month this year and it has severly affected our credit. The buyer has access to pay the loan but we are still named as the responsible party for the loan. We do not know if they attempted to assume the loan or not. They did not get the title in their name as well so we are still listed as owners. What can we do ?

Also we are trying to see if the business manager who signed the paperwork had power of attorney to do so. We do not know if this helps but the person who actually did the tranasaction with us and the name listed is different yet she signed each document in another name. Could someone help us please. TIA

You need to get a Real Estate Lawyer to help you in the city where this is occuring. Doing anything long distance is too difficult and will cost you more.
