My 18 year old daughter is dating a guy who is up on armed robbery. She is not telling me anything except: Months ago a store was robbed. The 2 men had masks on. The police found an item that belonged to her boyfriend at the scene.

Her boyfriend turned himself in. He was questioned and homes were searched. his mother put her house up for bail.

This was months ago. The two of them are planning to move out of state. How can a man move out of state if his mother put up bail? Why has he not been taken in front of a jury yet?

Is it that the officials do not think he's guilty? How and when do we know if it's all been dropped? Neither my daughter nor her boyfriend will give me any information.

Please, if anyone knows why this man was arrested for armed robbery sfter he turned himself in yet let free all these months, can you let me know the law?

Some trials take many months to come before a court ... others move quicker. It might be a year before it goes to trial.

And as long as he makes his court appearances, he is free on bail. And unless a condition of that release was to remain in the area, he is free to go most anyplace he wants to go.

No ... it's because he has not yet been found guilty of a crime, apparently.

You can call the court and find out. Court cases are public record and there should be a record of the pending hearing dates available to you.

Thank you so much. After you wrote to me, I had the nerve to call the superior court and I was given the following info:

This happened the beginning of Feb 2006. It is still in the complaint phase. Soon it will be placed in front of a grand jury. It may become an idictment. He then has to go in front of judges, etc.

The only thing they could not tell me is...why is he allowed to move 12 hours away? Can he live in another state until it goes to a grand jury? Does he then have to move back to NJ?

Again, thank you so much for the advice! I learned a lot today.

You're welcome.

Unless specifically forbidden by court order, he has the same rights as anyone else does. It's possible they could get an indictment and would then have to consider extradition if he as out of state.
