The very short end of the story is while employed for a credit card company in TX, I raised my credit limit from 2k to 50k with the access they gave me. i was recently caught and fired. Since my serperation police have contacted me and i am awaiting possible charges but i have no idea what, they say they may hold off since i am pregnant i should deliver in a couple of months. What can happen, am i going to loose my children I have never been in any trouble before? what type of punishment am I facing? What should I do? Please help I am very sorry for what I did, I am at a loss for words.....

But how can i get an attorney if i have no money? i have been unemployed for several months two kids/one on the way, and every lawyer wants like $5k. i know this sounds stupid but can someone try and defend themselves?

NO NO NO NO NO NO!! that is last thing you should do. Manyt Attorneys grant free intial consultation take them up on it. do not talk to Police with an Attorney present even if its Public Defender

The police already came to me and took a statement, can they use it against me? They said I was only going to make it better if I coperated. I am very scared, i was going threw a really bad time in my life when i did it with a very abusive husband and i was extremly depressed, saw a phsych. like every week because I was very suicidal. i wish i could have not done it or take it back but now my biggest fear is losing my kids. i think i should just face the fact that there is no hope. Do you know what will more than likely be my jail time...?

Unless we know both the state and charge no we cant. Yes anything you said to Police can be used against you. So if you have laready admitted to offense your dead! Talk to an Attorney!!!

r u serious

omg you have got to be kidding me dont they have to like read me my rights or something like that to let me know hey hello we are gunna use this against you, i can't believe your serious, they didn't even tell me possibly what charges i was facing, it said i wasn't be charged with anything on the paper, i can't believe this, that man told me half the stuff to write.

also the state is TX and like i said they never said anything about the charge until after i wrote down everything and at the top of the paper he wrote possible theft.

this is so unreal you try to make amends when you do wrong and it's like they want to hurt you worse cause u try and be honest now, i have never had so little faith in the justice system, i am not trying to say what i did was ok but i really dont want to go to jail, goodness even that guy who stole millions got probation

Your not looking at it realistically. 50 grand is a lot of money. Its not what you think but how the law reads. what you did was not like some simple shoplift that carries no jail time. Once more you need to contact an Attorney and arm yourself with knowledge. Get on internet and start calling! Once Police build their case they can show up at any time to arrest and charge you

I see your point, what i dont understand is what type of defense am i trying to build, unfortunatly i dont have the resource of getting an attorny they all want money and dont give you alot of information in a consltion, i have been to plenty, and i am here asking questions in free forums, to try and get knowledge and see what i am up against , i have to pretty much try and learn whatever i can, to you have any advice on resource links to previous law cases like this that might help?

You have not YET been charged, correct? If you have not yet been arrested or issued a summons, or had to appear in court to answer for the charges, then you have some breathing room.

If you cannot afford an attorney, one will be appointed for you by the court when you are arraigned.

So, you raised your own credit limit? Did you actually charge anything above the original amount? Have you defaulted on any charge accounts?

Have they told you what charges you might face? It may not be theft or larceny, but, instead, some offense involving improper or unlawful computer use or access.

And, Jacksgal was correct, Miranda is only necessary when you are both in custody and being interviewed. Since you were apparently not arrested, chances are your statement is not covered under Miranda.

After speaking to the police and making a statement I learned he was talking about charging me with theft. Now I know talking to them was a mistake but he never told me that at the beginning.

What is the difference between felonies, (i.e first degree felony vrs. third degree felony)?

Can I get a public defender for such offense since I cannot afford to hire one, and as dumb as this sound can I get one before charges are pressed?
