Shoplifting, Larceny, Robbery, Theft please help

I was caught shoplifting the other day, I have no prior shoplifting charges, I have 4 prior burglary convictions from 2010, I served time and still on probation, in arizona the shoplifting law says if you have 2 or more prior theft convictions a shoplifting charge can be a class 4 felony,I have court at the regular city court and so far it's being charged as a misdemeanor, who determines if they charge .me a felony or what,I was caught stealing a 7$ item,since my release from prison I have completed a 2 yr course for diesel tech, I have stayed drug free and have completely changed my life, it was just a spur of the moment dumb decision and I would hate to have to go back to prison for something so petty,any felony will send me back cause of my record, please help!

The district attorney or local prosecutor ultimately decides how each case will be charged.
You'll have to wait to see what he or she decides to do with you in your situation.

Side from that, you will have to worry about how your parole/probation office handles the situation. They can make a decision independent from the court action.

You need to tell your PO if you haven't already. You might also want to get yourself a lawyer if you haven't already.
