On 8/12/13 I called a plumbing company (Co.-A) ,to fix a sewerage back-up. I had cleaned up the water as soon as it happened, which caused no damage. Maybe two gallons of water, mostly from the shower. They then sub-contracted it to another company(Co.-B), because they were to busy to come to my house. Co. A was referred to me through Web site "TrustDale.com". Which offers satisfaction Guarantees. Co. B misdiagnosed the problem and believed to have fixed to the clogged sewer line. Five days later the same issue occurred with raw sewage coming up from the washing machine drain. Co b came back out and discovered that the actual problem was the main line outside the house was damaged from tree roots. This in turn was repaired at an additional cost. I have incurred @ $3,000+ in damages. Co A says they are not responsible because Co b did the actual work. Co B says they fixed the problem the first time and did not know about the root damaged line and it is just one of those unforeseeable instances . Is Company A or Company B responsible to pay for damages? Can I post this info on web sites?
 
What damages do you claim you are owed from the first incident? Did no one bother to run massive amounts of water through the lines to confirm the issue was fixed the first time? How can you be sure the clog from time A, did not snag on a tree root requiring B? Generally, based on the physical location of the lowest point in the property, water backs up there first. You are saying water backed up in two different places as the first indicator. Visit A the shower line. Visit B the washing machine line. It sounds like both companies may have done their job. The clog removed by visit A moved into the main lateral, caught on tree roots and then progressively caused a backup of solid material causing clog B.
 
As you explain it, only you are responsible for payment. It does not appear either company did anything wrong.

The $3000 is not damages, but repair costs. This is the sort of reason it is good to keep a home warranty policy. With an active policy you might have obtained the repairs for less than $100 (plus the cost of maintaining the yearly policy).
 
There were no damages resulting from the first incident. Water was run , but not massive amounts. The clog was from the tree root only, 1st and 2nd time. There was no clog from the shower, only the washing machine line. The first clog was pushed through the root area.
 
Your total contention is not supported by your story. You appear to acknowledge there were 2 clogs in the same week. What is the issue?

If you think the company is responsible for water damage from the second incident you are very wrong. Again, this is the sort of thing for warranties and insurance. The company has no responsibility for roots growing into your pipes.
