Two and a half years ago my mother re-wrote her will and gave both my brother and sister POA. My sister had her name put on all my mothers CDs and checking accounts. She then withdrew all the money and put it into another brothers name (not the one with the POA) with her as second signer. My father had two CDs that we had to go to probate court for and they were put in my mothers name about a year and a half ago. My sister proceeded to take both of those out and put them in her name alone. Because of deteriorationg health, my mother has been put into a nursing home. The brother with the POA and I went to an attorney that specializes in helping to get people on Medicaid for long term care. They said based on the amount of money that my mother had that we need to put back into my mothers account $42,000. I am afraid my sister that has POA and the other brother that has the money have already spent it because they won't give us this money to get her on Medicaid. This money was to be for my mothers care and what was left was to be split 6 ways. What would you recomend we do?

You need to sue the bad people for the money.

Actually contact the state office on aging. If they qualify her for Medicaid they will probably go after them for the money.
