I am breaking my lease early and in order to do so I have to put in my 30 days notice (already done) and pay a full months rent. So, in the mean time since I am not working, I decided to go for a swim, behold the pool is STILL closed for maintenance!! It has been down almost the entire time. Part of what we pay for are the amenities, in fact that is what their website tries to sell you on. Should I still be responsible for paying the full month when what I am partially paying for is not available to me? The pool has been down for months and now it's 93 degrees!!

I should also add, that along with the pool being shut, it also means that the propane bbq's and hot tub are not available for our use.

Yes, it has been approved with the condition that I pay an additional months rent. During the month of May, I will pay the 2 months rent. They claim that they just found out about the intake replacement on the pool law recently, the law was passed on December 19th, 2008 and they began repairs in February.

The fact that the pool (and barbecue/hot tub) are out of commission plays no role in what you and management agreed in terms of allowing you to break your lease early with just a one month financial penalty.

Management could have legally held you responsible for all of the remaining months on your lease (or until they were able to rerent the unit).
