Hello, so I recently recieved a letter in the mail that is a court summons to appear in court this coming Friday (May 2nd) for possession, this is what the letter reads exactly:
A complaint has been filed against you in this court charging that in Pinal County, Arizona you commited the crime of 13-3405A POSSESSION OF MARIJUANA, 13-3415A POSSESSION OF DRUG DRUG PARAPHERNALIA.
This is my story... on March 2nd 2008 I woke up from a nap at 6PM to find my best friend and room mate dead on my bedroom floor, reason unknown to me. I called 911, performed CPR until the paramedics showed up and let them take over from there. Afterwards police showed up and interviewed me, I told them that I had smoked pot the night before, I told them no lies as to the incidents leading up to my friends death. Now, I did have a pipe and a bag with very little pot in it in my room, not in plain site however. What confuses me is this, if they had discovered the pipe or pot, wouldn't they have confiscated it? It was still in my room after all the police had left. Could they charge me with these 2 counts of possession simply because I told them that I had smoked the night before? Someone please help me out here, I've been through alot in the past couple months and this is just more unneeded stress. On a side note, I quit smoking pot after that incident, so I am clean now, and do not intend on doing drugs again.
