Alcohol & Drugs: MIP, MIC, Intoxication possesion of alchohol

A few weeks ago i was at a party cops broke up. I was left behind and ended up with the officers. They were rude to me adn i wqs drunk so i was very rude back. I didnt give them my id when they asked so they cuffed me and took my purse and got it. I had lied to them about my information which i do not remember but was told about later. They took me to the detention center and breathilized me and i had a .3. Oh and i am seventeen years old. They put two charges against me one for possesion adn one for being drunk in public.
I looked up the va law (section 4.1-305) and its about buying and possesing alchohol but i was told that i had the charge because the alchohol was in my body because i did not phisically have it. It that right? Oh and they spelled my name incorrectly and i was told that was a loophole, is it?
 
Yes, they can charge you for having "internal" possession. it is, after all, proof that you were in possession, correct?

Be careful how much you want to fight this ... they might decide to add the false identification to a peace officer and even an obstruction charge. Take this as a lesson and be thankful they only charged the offenses they did. You can grow up and move past this if you sober up ... or, you can make a huge deal out of it and risk a real criminal jacket.

See if mom and dad are willing to shell out for an attorney for you.

.3? Are you sure? Plus it sounds like you had a blackout.

At my state, if you are at .3 or above you have to be hospitalized!

.08 is drunk as far as driving goes in all 50 states.

Perhaps you should look into taking a vacation from drinking. . .
 
I'm thinking that she meant to say .03 ... Like you say, if she were .3 (aka .30) she would have been messed up.
