Last night, me and three of my friends were outside near a park smoking a joint with marijuana inside of it. After maybe about 15 minutes, while i am not in possession of the marijuana, i turned to my left and I see three undercover police officers come our way. They asked us to stand up and one officer asked me to have my hands up against this wall. He asked me simple questions such as "do you have any drugs on you?" (which i didn't), "where are you from?" and he continued to search my pockets. One of my friends who had the joint admitted to the police officer that he had more marijuana in his possession inside his cigarette box. He had very little marijuana in that box, much less than one gram. One of the officers decided to have handcuffs placed on us. One of the other police officers was a bit hesitant to do so seeming to question the officer's decision. The officer who wanted us cuffed replied "Yeah, they were all smoking." So they precede to handcuff us and have us walk down a half block waiting for the cop car to arrive. They take us to the prescient, have us in the holding cell, scan our fingerprints and run our information through the system. None of us have records of anything and this is our first time offense. We eventually get our summons indicate where and when our court appearance is. My main concern is, during the arrest, none of the police officers read my friends and I our rights nor did they specify what we were being charged with (although its obviously for possession.) I wanted to know what my options were and if there was any way I could have this case completely dismissed with no punishment. Can anyone help?
