Good Afternoon All,
My husband and I own a small business. We were contracted out in May of this year for a job to be performed in December. This was for a professional photo shoot. I had a meeting with two people who signed our contract. One of the people eventually left their office and I had no contact with anyone for almost 6 weeks.
Fast forward to June 27th, 2008, I received an email form the remaining party that signed the contract. They (the clients) wanted to upgrade their package and add additional services.
A check was cut on July 9th, 2008 for the remaining amount and balance paid in full. It was also noted that no changes can be made to the account after November 12th, 2008.
Starting on November 14th, I started to receive emails about what additional items they would like to substitute, remove or add in. Nothing was every signed into contracts on this.
On December 11th, 2008 I had received a new medication from my doctor. Something I had never taken before. I took the very first dose that evening around 8pm. Around 2am the next morning which was December 12th, 2008 I woke up throwing up bile and blood. I was rushed via ambulance to the hospital. I was diagnosed with a severe allergic reaction to the mediction.
I was released on December 13th, 2008 @ 2am.
The problem is that my photo shoot for the company is on December 13th, 2008. As sick as I was I pulled myself together the best that I could and went to the shoot. Yes I was sick, yes I still went because I did not want to dissappoint them. I still had my bandages on from the hospital and hospital ID badge on might I add.
I arrived two hours early and about half an hour into set-up I became violently ill again. My anti-nausea medication was not working. I took more medication and went to lay down for an hour. (Not very professional, I know, but I was praying that the medication would kick in and I could continue to work.)
An hour before the shoot was to start one of the managers came to me and told me, "to just go home as I was not feeling well. And that she would contact me Sunday or Monday to reschedule the family shoots at their convenience."
I felt so bad leaving and did not want to, but they insisted. Now this morning I received a nasty email demanding repayment of everything including a non-refundable deposit.

Can someone explain to me what I am to do....

Thank You

I would work with them on this. Appologize for the inconvenience and try to explain there were cercumstances beyond your control. Offer to reschedule, if they don't accept that then refund the refundable portion of the contract and let them find another photographer. If the contract says "non-refundable" deposit, then the deposit is non-refundable. They knew that when they signed the contract.

Doh! There should be an "edit post" option. That way I would be able to hide my misspelled words, haha. (Apologize, circumstances)

Best of luck,
Nick
